Man Choked To Death on NYC Subway

Law enforcement officials told CBS News on Friday that a grand jury will likely hear the case of a New York man found de@d after being choked on a subway train next week.

Subway rider who allegedly put 30-year-old Jordan Neely in a chokehold on May 1 to restrain him after witnesses reported he was acting erratically would face criminal charges, which a grand jury will decide.

CBS New York reports that 24-year-old Marine veteran Daniel Penny was questioned by NYC police and then released after being seen in the video choking Neely.

Penny sent his sympathies to Neely’s family and friends in a Friday night statement posted by his lawyers. There is an allegation in the report that Neely had “a documented history of violent and erratic behavior, the apparent result of ongoing and untreated mental illness.”

Furthermore, it stated that Penny “never intended to harm Mr. Neely and could not have foreseen his untimely death.”

On Wednesday, the Office of the Chief Medical Examiner in New York City ruled Neely’s de@th a homicide.

“This is a solemn and serious matter that ended in the tragic loss of Jordan Neely’s life. As part of our rigorous ongoing investigation, we will review the Medical Examiner’s report, assess all available video and photo footage, identify and interview as many witnesses as possible, and obtain additional medical records,” said on Twitter.

The 24-year-old man is shown placing Neely in a chokehold for several minutes in the footage.

Neely is shown on the floor unmoving as two other riders struggle to control his arms but ultimately fail.

Neely acted irrationally on the train, throwing trash and shouting at passengers.
