He was found guilty of disorderly conduct on March 10, 2023. This case was decided by District Court Judge Vikki Bayeh-Haley in the City of Flint.

He may face up to 90 days in jail and a $500 fine. He then announced that the verdict will be delayed until April 25, 2023. On Twitter, Dave Bondy broke the news that Eric had resigned from his seat on the Flint City Council.

In 2010, Gildneer served 22 days of a 45-day sentence for drunk driving. He was the prosecutor in the case that led to his conviction.
