A Fox spokesperson stated on Wednesday that the network would be “ready to defend” itself against a similar lawsuit from a second voting system vendor.
This comes a day after Fox News agreed to pay $787.5 million to settle a defamation complaint launched by Dominion Voting Systems.
Following the historic Dominion settlement, the company Smartmatic released a statement on Tuesday reiterating its dedication to its own action, claiming that “Dominion’s litigation exposed some of the misconduct and damage caused by Fox’s disinformation campaign. Smartmatic will expose the rest.”
According to Smartmatic’s lawyer, J. Erik Connolly, “Smartmatic remains committed to clearing its name, recouping the significant damage done to the company in more than 50 countries, and holding Fox accountable for undermining democracy.”
On Wednesday, Fox responded, “We will be ready to defend this case surrounding extremely newsworthy events when it goes to trial, likely in 2025. As a report prepared by our financial expert shows, Smartmatic’s damages claims are implausible, disconnected from reality, and on its face intended to chill First Amendment freedoms.”
Florida-based Smartmatic is suing Fox News, For $2.7 billion, Fox paid hosts Maria Bartiromo and Jeanine Pirro, former Fox host Lou Dobbs, and Trump lawyer Rudy Giuliani. It was brought in February 2021.
At least seven defamation cases involving Fox News or Dominion Voting Systems are connected to statements made in the media about the 2020 election.

Dominion is still pursuing six further defamation lawsuits against other people it claims similarly promoted false allegations, including right-wing network Newsmax, and former Trump attorneys Rudy Giuliani and Sidney Powell, among others Dominion is also pursuing six additional lawsuits against the media.

In an effort to address worries about dwindling ratings and viewer retention, Dominion says the conservative network intentionally promoted fake conspiracy theories claiming Dominion had rigged the 2020 presidential election in favor of Joe Biden.
In response to Dominion’s allegations, Fox stated that it was merely reporting on noteworthy assertions made by then-President Donald Trump and his friends; they echoed this stance in a statement they released on Wednesday in relation to the Smartmatic lawsuit.
However, Dominion case judge Eric Davis effectively disallowed that argument, stating in a pre-trial finding that it “fails to shield” Fox from responsibility and that the court “will not apply the privilege here.”
Davis remarked in court at a hearing in the Dominion case, “Just because something is newsworthy doesn’t mean you can defame somebody.”
In a document submitted earlier this week, Fox News stated it “denies the allegation of a disinformation campaign.”
